Terms of Service
Automatically translated version. The Italian version prevails in the event of any dispute.
These terms govern access to and use of traguardo.ch (the "Service"), a web platform for FIDE A1/A2 French exam preparation. By using the Service you accept these terms. If you do not agree, do not use it.
1. Service provider
The Service is provided by Francesco Villano (the "Provider"), contactable at francesco@fvillano.com.
2. Account and eligibility
- To use the Service you must be at least 16 years old. If you are a minor, you need the consent of whoever holds parental responsibility.
- You must provide accurate information when registering and keep it up to date.
- You are responsible for the confidentiality of your credentials and all activities carried out on your account. Notify us immediately if you suspect unauthorised access.
- An account is strictly personal. You may not transfer, share or resell it to third parties.
3. What we offer
The Service provides educational tools for preparing for the FIDE A1/A2 French exam: structured lessons, an Italian–French bilingual glossary, oral and written comprehension exercises, oral and written production exercises, mock exams, and a readiness score.
The Service is a study platform. It does not issue certifications and is not officially affiliated with the State Secretariat for Migration (SEM) or any other body that administers the FIDE exam.
4. Free plan and subscription
- Free plan. A portion of the content is accessible free of charge, possibly subject to daily or volume limits.
- Paid subscription. Full access requires a subscription. Prices, billing frequency and duration are stated at the time of subscription.
- Payments. Payments are processed by Stripe Payments Europe, Ltd. We do not receive or store your card details. The list of accepted payment methods is that made available by Stripe.
- Automatic renewal. Unless stated otherwise, the subscription renews automatically at the end of each billing period, at the same price, until you cancel.
- Cancellation. You may cancel renewal at any time from the billing settings. Cancellation takes effect at the end of the current billing period. You will continue to have access to the Service until that date.
- Price changes. Any price changes will be communicated by email at least 30 days before the new price takes effect. If you disagree you may cancel the subscription before the renewal date, at no cost.
- Non-payment. In the event of a failed charge, we may suspend access to paid features until the matter is resolved.
5. Right of withdrawal (EU consumers)
If you are a consumer resident in the European Union, you have 14 days from the date of subscription to withdraw from the contract without giving reasons, pursuant to Directive 2011/83/EU.
However, since the Service is digital content supplied immediately, when subscribing to a paid plan we ask you to expressly consent to the immediate commencement of performance and to acknowledge that, by doing so, you lose the right of withdrawal under art. 16(m) of the same Directive. If you do not wish to waive your right of withdrawal, do not subscribe to the paid plan.
To exercise withdrawal within the applicable window, write to francesco@fvillano.com.
6. Acceptable use
By using the Service, you agree not to:
- violate applicable laws or third-party rights (intellectual property, privacy, dignity);
- bulk-download, copy, redistribute or resell course content (lessons, texts, audio, images, glossary);
- automate access to the Service (bots, scraping, reverse engineering, mass extraction of LLM-generated content);
- attempt to circumvent access restrictions, payment systems or usage quotas;
- upload to oral or written sessions unlawful, offensive or harmful content, third-party personal data without consent, malware or executable code;
- use the Service for purposes other than personal FIDE exam preparation (e.g. commercial resale of material, training other users, training AI models).
In the event of a breach we may suspend or close the account, including without notice where the breach is serious or repeated.
7. Intellectual property
All course content (lessons, glossary, exercises, audio, images, code, graphics and the "traguardo.ch" brand) is owned by the Provider or its licensors and is protected by copyright law.
We grant you a personal, non-exclusive, non-transferable and non-sublicensable licence to use the Service for your individual FIDE exam preparation, for the duration of your access. This licence does not entail any transfer of intellectual property.
8. Your content
The answers you write, the voice recordings you submit and any other content you generate while using the Service (your "Content") remain your property.
To provide you with the Service (transcribing, evaluating, showing you results, calculating the readiness score), you grant us a limited, non-exclusive, royalty-free licence to process your Content for the purposes of the Service. We do not use your Content to train AI models, nor do we share it for promotional purposes.
You are responsible for the content you submit and warrant that you hold the necessary rights.
9. AI examiner and third-party providers
The virtual examiner, voice transcription, voice synthesis and image generation rely on services provided by third parties (in particular OpenAI, ElevenLabs and Google Gemini). Scores and feedback are generated automatically and may contain errors. They are intended as an indication of preparation, not as a binding prediction of exam results.
For details of the data we share with these providers, please see our privacy policy. ↗
10. Availability and no guarantee of passing the exam
We endeavour to keep the Service available and to fix known issues within a reasonable time. However, the Service is provided "as is", without express or implied warranties of uninterrupted operation, accuracy of automatically generated content, or fitness for any purpose other than personal exam preparation.
We do not guarantee that using the Service will result in you passing the FIDE exam. The outcome depends on many factors outside our control. The readiness score is a statistical estimate calibrated on your performance and should be understood as an indication, not a certainty.
11. Limitation of liability
To the extent permitted by law, the Provider's total liability to you, for any reason, shall not exceed the amount you have paid for the Service in the 12 months preceding the event giving rise to the liability.
The Provider is not liable for indirect, incidental, consequential or special damages, loss of data, loss of profits or opportunities, failure to pass the exam, costs of retaking the exam or ancillary expenses.
Nothing in these terms excludes or limits liability for fraud, gross negligence, personal injury or any other liability that cannot be excluded by law.
12. Suspension and termination
- You. You may stop using the Service at any time and delete your account from settings. Deletion follows the procedure described on the data deletion page. ↗
- Provider. We may suspend or terminate access to the Service in the event of a breach of these terms, a security risk, non-payment or discontinuation of the Service itself. Where possible, we will give you reasonable notice.
- In the event of Service discontinuation not attributable to your breach, you will receive a proportional refund for any paid and unused subscription period.
13. Changes to terms
We may update these terms to reflect changes to the Service, legislation or our practices. Significant changes will be communicated by email at least 30 days before they take effect. If you do not accept the changes you may cancel your subscription before the effective date.
14. Privacy and personal data
The processing of your personal data is described in the privacy policy, which forms an integral part of these terms. ↗
15. Governing law and jurisdiction
These terms are governed by Swiss law, excluding conflict-of-law rules. The courts of the Provider's domicile have jurisdiction, without prejudice to mandatory consumer-protection rules in force in the country of your habitual residence.
If you are a consumer resident in the European Union, you may also refer your dispute to the EU Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
